1. Предмет соглашения
   1. Правообладатель за вознаграждение передает во временное пользование, а Пользователь получает право на временное использование программ для ЭВМ, именуемой в дальнейшем «Программный Продукт, ПП» или «ПО». Пользователь получает возможность использования ПП только в облачной инфраструктуре Yandex Cloud для ПП, создаваемой через соответствующую функциональность площадки Yandex Cloud Marketplace со страницы ПП;
   2. Состав передаваемого Программного Продукта изложен в Приложении №3 к настоящему Договору, которое является его неотъемлемой частью;
   3. Право собственности на Программный продукт не переходит к Пользователю, но остается у Правообладателя
2. Предоставление права пользования
   1. Пользователь вправе использовать Программный Продукт в соответствии с его назначением, за исключением действий, оговоренных в п. 2.2. данного соглашения.
   2. Пользователь не вправе:
      1. Сохранять ПП на собственное или иное оборудование, изготавливать копии Программного Продукта;
      2. Запускать/использовать ПП на ресурсах, кроме создаваемых в Yandex Cloud Marketplace из соответствующего раздела с функционалом развёртывания ПП в облаке Yandex Cloud;
      3. Передавать любым способом третьим лицам права на использование Программного Продукта, а также передавать (распространять) копии (экземпляры) Программного Продукта;
      4. Выдавать сублицензии, передавать Программный Продукт напрокат и предоставлять на условиях аренды;
      5. Упоминать Программный Продукт в публикациях и выступлениях без ссылки на Правообладателя;
      6. Использовать для любой цели за исключением деловых операций Пользователя;
      7. Производить инженерный анализ, декомпилировать, разбирать или иным образом пытаться перевести любой объектный код в доступную человеческому восприятию форму или разрешать другим лицам делать это. Правообладатель гарантирует, что пакеты Программного Продукта не содержат вредоносной логики, несанкционированного сбора персональной информации, активностей Пользователя, финансовой и коммерчески важной информации Пользователя;
      8. Раскрывать Программный Продукт, разрешать использовать или открывать доступ к нему третьей стороне
3. Цена и порядок оплаты
   1. Все исключительные права на Программный Продукт принадлежат Правообладателю и защищены действующим законодательством. Пользователь получает неисключительное право на использование Программного Продукта в объеме, предусмотренном настоящим Соглашением;
   2. Правообладатель предоставляет Пользователю возможность использования Программного Продукта посредством его запуска в инфраструктуре Yandex Cloud, создаваемой со странице ПП на площадке Yandex Cloud Marketplace.
4. Права на интеллектуальную собственность
   1. Все исключительные права на Программный Продукт принадлежат Правообладателю и защищены действующим законодательством. Пользователь получает неисключительное право на использование Программного Продукта в объеме, предусмотренном настоящим Соглашением;
   2. Правообладатель предоставляет Пользователю возможность использования Программного Продукта посредством его запуска в инфраструктуре Yandex Cloud, создаваемой со странице ПП на площадке Yandex Cloud Marketplace.
5. Передача программного продукта
   1. Установка ПП осуществляется только в инфраструктуре Yandex Cloud с помощью соответствующего функционала Yandex Cloud Marketplace со страницы ПП по размещённой там инструкции;
   2. Запуск продукта осуществляется через инструменты управления Yandex Cloud в аккаунте пользователя на ресурсах, созданных с помощью функционала Yandex Cloud Marketplace со страницы ПП по размещённой там инструкции.
6. Ответственность сторон
   1. За неисполнение или ненадлежащее исполнение условий Соглашения, Пользователь несёт ответственность в соответствии с действующим законодательством Российской Федерации.
7. Ограничение ответственности
   1. Правообладатель не несет никакой ответственности за результаты коммерческой деятельности, получаемые в связи с использованием Пользователем в своей деятельности Программного Продукта, как то за потерю прибыли Пользователем, сохранность данных, а также иные убытки Пользователя.

1. Subject of Agreement
   1. The Right Holder transfers for a fee, and the User receives the right to temporary use of computer programs, hereinafter referred to as "Software Product" or "SP". The User is granted the ability to use the SP exclusively within the Yandex Cloud infrastructure for SP, created through the relevant functionality of the Yandex Cloud Marketplace from the SP page;
   2. The composition of the transferred Software Product is presented in Annex No. 3 to this Agreement, which is its integral part;
   3. Ownership rights to the Software Product do not transfer to the User and remain with the Right Holder
2. Provision of Usage Rights
   1. The User is entitled to use the Software Product in accordance with its purpose, with the exception of actions specified in section 2.2. of this Agreement.
   2. The User is not entitled to:
      1. store the SP on their own or other equipment, create copies of the Software Product;
      2. run/use the SP on resources other than those created in Yandex Cloud Marketplace from the respective section with the functionality of deploying the SP in the Yandex Cloud;
      3. transfer rights to use the Software Product to third parties in any way, as well as transfer (distribute) copies (instances) of the Software Product;
      4. sublicense, rent the Software Product, or provide it on rental terms;
      5. mention the Software Product in publications and presentations without reference to the Right Holder;
      6. use it for any purposes other than User’s business operations;
      7. perform reverse engineering, decompile, disassemble, or otherwise attempt to translate any object code into a human-readable form or allow others to do so.
      8. The Right Holder guarantees that the Software Product packages do not contain malicious logic, unauthorized collection of personal information, User’s activities, financial, and commercially sensitive User information; disclose the Software Product, allow its use or provide access to it to third parties.
3. Price and Payment Procedure
   1. All exclusive rights to the Software Product belong to the Right Holder and are protected by applicable legislation. The User receives a non-exclusive right to use the Software Product within the scope provided by this Agreement;
   2. The Right Holder provides the User with the ability to use the Software Product by launching it in the Yandex Cloud infrastructure, created from the SP page on the Yandex Cloud Marketplace.
4. Intellectual Property Rights
   1. All exclusive rights to the Software Product belong to the Right Holder and are protected by applicable legislation. The User receives a non-exclusive right to use the Software Product within the scope provided by this Agreement
   2. The Right Holder provides the User with the ability to use the Software Product by launching it in the Yandex Cloud infrastructure, created from the SP page on the Yandex Cloud Marketplace.
5. Transfer of Software Product
   1. The installation of the SP is carried out only in the Yandex Cloud infrastructure using the relevant functionality of the Yandex Cloud Marketplace from the SP page according to the instructions placed there;
   2. The launch of the product is carried out through the Yandex Cloud management tools in the user’s account on resources created using the Yandex Cloud Marketplace functionality from the SP page according to the instructions placed there.
6. Responsibility of the Parties
   1. For non-fulfillment or improper fulfillment of the Agreement terms, the User bears responsibility in accordance with the applicable legislation of the Russian Federation.
7. Limitation of Liability
   1. The Right Holder assumes no liability for the results of commercial activity obtained as a result of the User’s use of the Software Product in their business operations, such as loss of profit, data integrity, and other User losses.
